Filing Workers’ Compensation

- file an application for adjudication of claim with the state’s Workers’ Compensation Appeals Board
Reporting the injury
One of the first things to do after sustaining an injury is to get medical treatment. In case of an emergency, you are free to choose where to be treated. In case your employer or their insurance company has a medical provider network, you may have to stick with a doctor who is in that particular network.
A successful filing for California Workers’ Compensation insurance requires that you inform your employer about your injury. This is done in writing and must be submitted within 30 days of sustaining the injury.
Filing a claim with employer
Your employer will give you a form after you have filed for a claim. You just have to follow the instructions found on the document. After which, you have to send that to your employer, who then forwards it to their insurance company.
After submitting the form, you must hear from the insurance company of our employer. This is important since insurance companies will be the ones paying for medical treatment. In other words, they have to give their blessing.
Filing an application for adjudication of claim
If you filed a claim with your employer, you will need to file an Application for Adjudication of Claim. This must be done within one year of sustaining an injury. Why is this important? It allows you to settle disputes associated with WCAB.
